TERMS & CONDITIONS

These terms and conditions (“Terms”) govern your attendance of Keystone Cooperative, Inc.’s Co-op Classic event (the “Event”). By attending the Event you KNOWINGLY AND VOLUNTARILY ASSUME ALL RISKS, HAZARDS, AND DANGERS incident to the Event and related activities, including the risk of personal injury (including death), exposure to communicable diseases, viruses, bacteria or illnesses (including, e.g., COVID-19), or the causes thereof, or lost, stolen or damaged property, whether occurring before, during, or after the Event, however caused, and you hereby waive all claims and potential claims relating to such risks, hazards and dangers.

You agree to indemnify, defend, and hold harmless Keystone Cooperative, Inc. from any and all liability, losses, damages, judgments, or expenses, including attorneys' fees, that you may incur or sustain as a result of your attendance of the Event and participation in related activities, arising out of any third-party claim.

You understand and agree that during the Event you may be photographed and/or videotaped by Keystone Cooperative, Inc. and/or its agents for internal and/or promotional use. You consent to such photographing and videotaping and Keystone Cooperative, Inc.’s use of your name, image, likeness, and voice in perpetuity, in any medium or format, for any publicity without further compensation or permission. You further grant and convey to Keystone Cooperative, Inc. all right, title, and interest in any and all such photographs or recordings.

RELEASE, WAIVER & COVENANT NOT TO SUE. You knowingly and voluntarily release and covenant not to sue Keystone Cooperative, Inc. with respect to any and all claims that you may now have or that hereafter accrue, whether known or unknown, against Keystone Cooperative, Inc. that relate to any of the risks, hazards, and dangers described above or resulting from anything which has happened up to now, including without limitation any and all claims that arise out of or relate in any way to your entry into, or presence within or around, the Event (including without limitation in parking areas or entry gates) and your participation in Event related activities, in each case whether caused by any action, inaction or negligence of Keystone Cooperative, Inc. or otherwise. YOU UNDERSTAND THAT YOU ARE RELEASING AND WAIVING CERTAIN POTENTIAL RIGHTS HELD BY YOU.
