BUDGET PROGRAM TERMS AND CONDITIONS

Acceptance of Terms. These terms are between you and Keystone Cooperative, Inc. (“Keystone”, “we”, “us”) and govern the Budget Program. By enrolling in the Budget Program and making payments under the Budget Program you agree to and accept these Terms. These Terms may be amended from time to time. A link to these Terms will be provided to you prior to each contract period. 

Term. The Budget Program is an annual program where you pay equal monthly payments during the year. Each year runs from July 1st through June 30 and is referred to as a “contract period”. You will remain enrolled in the Budget Program from year to year unless you choose, at any time, to cancel your enrollment, as set forth within these terms and conditions (“Terms”). We reserve the right to deny auto renewal in our sole discretion. 

Price. Prior to the beginning of a new contract period, you will receive notification of the new contract period’s term calculations, including gallons and monthly payment. The identified fixed prices are valid October 1st through March 31st of the applicable contract period. Your initial monthly payment is an approximation and calculated based on your estimated annual usage. Should your actual costs exceed this estimate, we reserve the right to adjust the monthly payments accordingly. 

Payment. Payments are due on the 25th of each month during each contract period. Any overpayments will be applied to the next contract period or can be refunded at the end of the current contract period upon your request. Any balances owed at the end of a contract period must be paid in full by June 25th to be eligible for the next contract period. It is agreed that all payments will be applied toward your purchase price of the products and necessary services covered by the Budget Program. 

Cancellation. You may cancel your enrollment at any time by informing us that you no longer wish to participate in the Budget Program. We may cancel your enrollment if you no longer meet the requirements of the Budget Program or if you breach your obligations under these Terms, including your payment obligations. If you are removed from the Budget Program, you are responsible for placing orders with Keystone. If you choose to discontinue participating in the Budget Program, Keystone’s normal fees and interest may apply. 

Delivery. Products purchased under the Budget Program will be delivered as needed upon the approval of Keystone’s Credit Department. 

Governing Law. These Terms are governed by the laws of the state of Indiana. In the event of judicial proceedings, all parties agree that Marion County, Indiana shall be the venue for all such proceedings. 

Assignability. Your enrollment in the Budget Program is not assignable without prior written consent of Keystone.

Liability. Keystone is not responsible for loss of heat or any resulting damage arising from a freeze-up in a dwelling or home. It is your responsibility to protect your home against damage arising from a drop in heat. You should arrange for daily temperature monitoring if planning to be away from the premises for any length of time. 

Entire Contract. These Terms, and any enrollment form or existing contract between you and Keystone or any of its predecessors, constitute your entire contract between you and Keystone for the Budget Program.
